Theft By Deception N.J.S.A. 2C:20-4

Purposely obtain property by deception by purposely:

  1. Creates or reinforces false impression
  2. Prevents another from acquiring information which would affect his judgment of transaction; or
  3. Fails to correct false impression which deceiver previously created or reinforced

Theft By Unlawful Taking Or Disposition N.J.S.A. 2C:20-3

  1. Movable Property: unlawfully takes or exercises control over movable property of another with purpose to deprive
  2. Immovable Property: unlawfully transfers any interest in immovable property of another with purpose to benefit someone not entitled to it
  3. Publicize or expose secret subjecting someone to hatred, contempt or ridicule or impair his credit or business
  4. Take or withhold action as an official or cause an official to take or withhold action
  5. Bring about or continue to strike/boycott if property is not received
  6. Testify, provide information or withhold testimony/information regarding another’s legal claim/defense; or
  7. Inflict any other harm which would not substantially benefit actor and calculated to harm another

Theft By Extortion N.J.S.A. 2C:20-5

Purposely and unlawfully obtains property by extortion by threatening to:

Inflict bodily injury or physically confine or restrain or commit any other criminal offense

Accuse anyone of offense or cause charges to be instituted against person

What Degree Is My Theft Charge?

Second Degree: amount involved is $75k or more, property is taken by extortion, property stolen is CDS in excess of 1 kilogram or human remains

Third Degree: amount involved exceeds $500 but is less than $75k, property stolen is a firearm, motor vehicle, vessel, boat, horse, domestic companion animal or airplane, CDS 1 kilogram or less

Fourth Degree: amount involved is at least $200 but does not exceed $500

Disorderly Persons Offense: amount involved is less than $200
