1st Offense:
- $500 fine
- up to 6 months loss of license
- if offense occurs while your driver’s license is suspended due to a dui, revocation of your motor vehicle registration privilege
2nd Offense:
- $750 fine
- jail for at least 1 day, but not more than 5 days
- up to 6 months loss of license
- if second offense occurs while your driver’s license is suspended and the second offense is within 5 years of a conviction for same offense, revocation of your motor vehicle registration privilege
3rd Offense:
- $1000 fine
- 10 days jail
- Up to 6 months loss of license
- if third or subsequent offense occurs while your license is suspended and the third or subsequent offense is within 5 years of a conviction for same offense, revocation of motor vehicle registration privilege

In addition to the above penalties and fines, 45-180 days in jail
Other Potential Issues
There are enhanced fines, jail time, and loss of license time periods if the original suspension was a result of being convicted or pleading guilty to 39:6B-2 or 39:4-50, or if the event occurred on school property.
